1. PERSONAL INFORMATION

This privacy policy (the “Privacy Policy”) sets forth our privacy practices. We are committed to protecting your personal information. We have created this Privacy Policy to let you know what information we collect when you use our Services, why we collect this information and how we use the collected information.

We may periodically update this Privacy Policy and will notify you of these changes by posting the modified terms on the Platform. We recommend that you revisit this Privacy Policy regularly.

We consider information that may be used to identify an individual, including, but not limited to, first and last name, date of birth, social security number, home or other physical address, email address, phone number or other contact information to be Personal Information (“Personal Information”). You may be asked to provide Personal Information when you use our website, register for an account or to use the Services.

The Personal Information that we collect may include information such as: name, contact information (including telephone number), shipping information, billing information, including credit card and other account numbers, full social security number, geo-location information, wagering history, transaction history, website usage preferences, and feedback regarding the Services. This information is held by us on servers based in Atlantic City, New Jersey and elsewhere from time to time. In addition, when you interact with the Services, our servers keep an activity log unique to you that collects certain administrative and traffic information including: source IP address, time of access, date of access, web page(s) visited, language use, software crash reports and type of browser used. This information is essential for the provision and quality of the Services.

We monitor and record wagering communications and geographic location information. In connection with your use of the Services, we record and maintain the following information: (a) the date and time your Account is opened or terminated; (b) the date and time your Account is logged in to or is logged out of; and (c) your physical location when logged in to your Account. The NJDGE may also monitor and record wagering communications and geographic location information. 

2. LOCATION SERVICES
We may use a third-party cell phone-based subscription method to ensure that you are physically located in New Jersey, as required by the NJDGE for use of the Services (the “Location Services”). Certain service providers, including GeoComply, will make use of your location data. You hereby consent to us and/or to GeoComply (or such other third-party geo-location providers) transmitting, collecting, maintaining, processing and using your location data for the following purposes: to allow us and any of our third-party geo-location providers to physically locate your cell phone periodically while you are logged into the Services, to determine whether you are eligible to use the Services, to test and improve location-based products and Services, for the prevention of fraud and other illegal activity, to protect our interests and the interests of others, and for other reasonable purposes related to the provision of our Services.

If you do not wish to allow the Location Services to track your geo-location, you may disable the Location setting for the Stardust Casino application in the Settings App on your phone, but doing so will disable your ability to use the Services. The Location Services use location data, and by using the Services, you consent and permit your wireless carrier to share your location with us and/ or GeoComply and/ or any other third-party geo-location provider. Your location information is retained for up to ten years as required by the NJDGE and applicable state and federal regulations. Location coordinate data is transmitted via Secure Socket Layer (SSL) technology and stored in password protected servers managed by us and our geo-location and operating partners. GeoComply will not pass on or resell your data to any third party except that they reserve the right to provide location information as necessary to satisfy any law, regulation or government agency request.

To the extent we can do so, we may link your Personal Information with information that is not personally identifiable. We may also link information collected online with information we collect offline or that is collected online by third parties.

3. COLLECTION OF PERSONAL INFORMATION
We may automatically collect certain data as discussed above and receive Personal Information about you where you provide such information through the Services or other communications and interactions with us. We may also receive Personal Information from online vendors and service providers, and from customer lists lawfully acquired from third-party vendors. In addition, we may engage the services of third-party service providers to provide technical support, process your online transactions and maintain your Account. We will have access to any information you provide to such vendors, service providers and third-party e-commerce services, and we will use the Personal Information as set out in this Privacy Policy. This information will only be disclosed to third parties in accordance with this Privacy Policy. We take steps to ensure that our arrangements with third-party service providers and online vendors protect your privacy.

From time-to-time, we may request information from you via surveys or contests. Participation in these surveys or contests is completely voluntary, and, therefore, you have the choice of whether or not to disclose such information. Information requested may include contact information (such as name, correspondence address and telephone number), and demographic information (such as zip or postal code or age). By accepting any contest prize or winnings from us, you consent to use of your name and likeness for advertising and promotional purposes without additional compensation, except where prohibited by law.

4. INFORMATION USE
We use the Personal Information we collect from you to deliver our Services, to provide customer support, to undertake necessary security and identify verification checks, to process any of your online transactions, to assist your participation in third-party promotions, meet certain business requirements and for any other purpose related to the operation or improvement of the Services. As such, we may share your Personal Information with our affiliates and our carefully selected partners (which will include any other parties which such partners have entered into data sharing arrangements with). If, in our sole determination, you are found to have cheated or attempted to defraud us, the Group, or any other user of the Services in any way including, but not limited to, game manipulation or payment fraud, or if we suspect you of fraudulent payment, including use of stolen credit cards, or any other fraudulent activity (including any chargeback or other reversal of a payment) or prohibited transaction (including money laundering), we reserve the right to share this information (together with your identity and any relevant Personal Information) with other online gaming sites, banks, credit card companies. For the purpose of research on the prevention of addiction, your Personal Information may be made anonymous and passed on to the respective institutions and appropriate agencies.

To opt-out of and stop receiving our automated calls and texts, reply “STOP” to any text message from or on behalf of us. You agree to and may then receive a single final text message confirming your opt-out from such future calls and texts. Standard text and calling rates will apply to your phone communications. Any and all such charges, fees, or costs are your sole responsibility.

10. CONSENT TO USE OF ANTI-CHEATING SOFTWARE
Our software package – used to access and use the Services – contains certain features designed to detect use of automated programs that enable artificial (non-human) intelligence to play on our site. Use of such “bot” software programs violates our Terms and Conditions, where we deem it detrimental to other players. By installing our software and using the Services, you consent to our software performing the functions described in this section. Our software may perform any or all of the following functions in order to detect the use of illicit automated programs and ensure that we maintain a “cheat free” environment for all users: (1) scan your list of active software applications while you are using the Services; (2) scan your list of active processes while you are using the Services; and (3) scan the files in your Services and site-related program folders to ensure that only “non-hacked” versions of our software are being used. If any of the foregoing processes reveals a suspect application or process, our software may scan the files associated with the suspect application or process and compile a composite mesh (i.e., a profile that characterizes the files associated with the application or process) to be matched against profiles for known illicit automated programs. Our software may scan your device operating system to determine if it has been altered in a manner unauthorized by its manufacturer or “jailbroken.” Our software will not perform any random search of large portions of your hard drive, equipment or files, and it will not transmit any information to us or to any third party other than the information necessary to identify use of illicit automated programs as described above. Our software will not alter any files or information on your computer or other equipment and will not interfere with the operation of any of your applications. you may terminate use of our software at any time by uninstalling our software package.

11. SECURITY
We understand the importance of information security and the techniques needed to secure information. We store your personal information in secure and encrypted data base structures. Our Services support TLS 1.2 with 128-bit encryption. We take steps to ensure our subsidiaries, agents, affiliates and suppliers also employ adequate levels of security. In spite of these protections, we cannot guarantee the security of any data submitted over the internet.

12. PROTECTION OF CHILDREN
The Services are not intended for or directed at persons under the age of twenty-one (21). Any person who provides their information to us through any part of the Services represents to us that they are twenty-one (21) years of age or older. It is our policy to uncover attempts by minors to access our Services which may involve us having to access and verify your Personal Information. If we become aware that a minor has attempted to or has submitted personal information via the Services, we will not accept this information and will take steps to remove such information from our records.

13 INTERNATIONAL TRANSFERS
Personal Information collected on the Services may be stored and processed in any country in which we or our affiliates, suppliers, ESPs or agents maintain facilities. By using the Services, you expressly consent to any transfer of information outside of your country (including to third countries that may not have been assessed as having adequate privacy laws). Nevertheless, we take steps to ensure that our agents, affiliates and suppliers comply with our standards of privacy regardless of their location.

14 THIRD-PARTY PRACTICES
We cannot ensure the protection of any information or images that you provide to a third-party online site that links to or from the Services or any information collected by any third party administering our affiliate program (if applicable) or any other program, since these third-party online sites are owned and operated independently of us. Any information collected by these third parties is not governed by this Privacy Policy but by the privacy policy, if any, of such third party. If you have questions about a third party’s information practices, please read its privacy policy. We assume no responsibility or liability whatsoever for the practices, actions or policies of such third parties, and we are not responsible for the content or privacy practices of such online sites.

15 MERGERS AND OTHER EVENTS REQUIRING TRANSFER
If we should ever file for bankruptcy, or become insolvent, or be acquired by a third party, merge with a third party, sell all or part of our assets, or transfer substantially all or part of our relevant assets to a third party, we are entitled to share the Personal Information and all other information you have provided through the Services to potential and subsequent business and merger partners. By agreeing to the standard Terms and Conditions of Use, you hereby give your consent to such transfer of this information.

16. DO NOT TRACK
Your browser and other mechanisms may permit you to send do-not-track signals or other similar signals to express your preferences regarding online tracking. However, because there is not yet a defined response to do-not-track requests, our website does not respond to your browser’s do-not-track request. As noted above, third parties, such as our advertising partners, may collect data that relates to you. We cannot control third parties’ responses to do-not-track signals or other such mechanisms. Third parties’ use of data relating to you and responsiveness to do-not-track signals is governed by their respective privacy policies.

17. PAYMENTS.
Payments will be made as soon as reasonably possible (subject to up to three business days internal processing time), although there may be delays due to any security review undertaken by Stardust Casino and save where Stardust Casino holds any such payments in accordance with these Terms, or any other agreement between you and Stardust Casino. Under penalties of perjury, you declare that, to the best of your knowledge and belief, the name, address, and social security information that you have furnished correctly identify you as the recipient of any jackpot payments and any payments from identical wagers, and that no other person is entitled to any part of these payments.

18. CONSENT TO ELECTRONIC DELIVERY OF TAX DOCUMENTS
You acknowledge the Form W2G may be issued by Stardust Casino by January 31 following the year of the payment. By accepting these Terms, you acknowledge that any casino winnings/jackpots winnings of one thousand two hundred US dollars ($1,200) or more, and poker tournament winnings of more than $5,000 that you win by using the Services are subject to the IRS regulations, and you permit your acceptance of these Terms to serve as an electronic signature and to suffice any acceptance and signature on any tax documents incurred during the internet gaming activity.

Your acceptance of the Terms serves as acknowledgment that the Form 1099-Misc may be issued by us by January 31 following the year of the receipt of a prize consisting of cash or merchandise for which a 12-month accumulated value of six hundred US dollars ($600) or more won by using the Services are subject to the IRS regulations.

By accepting the Terms, you consent to receive delivery of any required tax reporting documents, including Form W-2G, via electronic delivery. If you withdraw consent, a paper copy will be provided. A revocation of consent applies only to the current form and shall not effect consent for prior years. Consent to receive documents electronically shall apply to all forms going forward until revoked. We will retain any W-2G delivered electronically for seven years, and it can be viewed and downloaded online [in the account section of your Stardust.com account. If you can no longer access your account online you can request a paper copy with the instructions above. Your W-2 will be available in PDF format, and can be viewed by any computer and mobile device that can connect to the internet and capable of displaying PDF files. PDF files can be opened directly by most modern web browsers or using Adobe Acrobat Reader, a free software published by Adobe, Inc.

19. CONSENT TO PRIVACY POLICY
By clicking ‘Submit’ or ‘I agree’ during the registration process or by your continued use of the Services following the posting of this Privacy Policy (as applicable), you agree to this Privacy Policy. This is our entire and exclusive Privacy Policy, and it supersedes any earlier version. This Privacy Policy should be read in conjunction with the Terms and Conditions and any additional applicable terms posted on our Platforms. We may periodically amend this Privacy Policy and will notify you of these changes by posting the modified terms on our Platforms. We recommend that you revisit this Privacy Policy regularly.
